KAJIAN STATUS PROVINSI NUSA TENGGARA TIMUR SEBAGAI PROVINSI KEPULAUAN DITINJAU DARI PERSPEKTIF HUKUM (STUDY OF NTT PROVINCE'S STATUS AS AN ISLAND PROVINCE: OVERVIEW FROM LAW PERSPECTIVE)

East Nusa Tenggara (NTT) consisting of inhibited and unhibited islands has enormous sea and natural resources with both comparative and cooperative advantages. However, the utilization and management of marine and fisheries resources are still facing limitations such as lack of sea and special port infrastructure, transportation, communication, water, electricity, health, and education facilities. In addition, the development in the Capital of the Province/District which tends to be cliquish along with infrastructure constraints and inequality lead to another problem for managing government in East Nusa Tenggara. In fact, the treatment for managing East Nusa Tenggara Islands cannot be equal with other provinces in Indonesia since it is not mainly land area. Constitutionally, Act Number 32 Year 2004 has not accommodated East Nusa Tenggara Provincial Government geographically since the range of development is wider and spreads across the islands. As a result, there is not enough budget support in the calculation of General Allocation Fund. Consequently, the public service in the islands can not be implemented efficiently and effectively.

Wilayah Nusa Tenggara Timur (NTT) yang berpulau-pulau, baik yang berpenghuni maupun yang tidak dihuni memiliki potensi wilayah laut yang luas dan sumberdaya alam yang dimiliki Pemerintah Provinsi NTT sesungguhnya dapat memiliki keunggulan komparatitif dan keunggulan kooperatif. Namun pemanfaatan dan pengelolaan sumber daya alam perikanan dan kelautan yang dimiliki masih mengalami berbagai keterbatasan-keterbatasan seperti infrastruktur pelabuhan laut/pelabuhan khusus, sarana transportasi, sarana komunikasi, air bersih, listrik, kesehatan dan sarana pendidikan. Oleh karena, pembangunan cendrung berkelompok di kawasan Ibukota Provinsi/Kabupaten dan keterbatasan serta ketimpangan infrastruktur mendatangkan kendala tersendiri bagi pengelolaan pemerintahan di NTT karena pengelolaan pulau- pulau NTT sama perlakuannya dengan pengelolaan provinsi lainnya di Indonesia padahal seharusnya pengelolaan di NTT berbeda perlakuannya dengan wilayah daratan. Secara konstitusi Undang-Undang Nomor 32 Tahun 2004 belum mengakomodir Pemerintah Provinsi NTT yang secara geografis merupakan wilayah kepulauan yang mengapresiasi kepentingan daerah belum mendapat perlakuan yang adil dan merata. Padahal jangkauan pembangunan lebih luas dan tersebar di pulau-pulau, namun belum mendapatkan dukungan dana dalam perhitungan dana perimbangan (Dana Alokasi Umum). Hal ini menyebabkan pelayanan publik pada pulau-pulau tidak dapat dilaksanakan secara efisien dan efektif.
