ANALISIS IMPLEMENTASI PERATURAN MENTERI PERDAGANGAN NOMOR 44/M-DAG/PER/9/2009 TENTANG PENGADAAN, DISTRIBUSI DAN PENGAWASAN BAHAN BERBAHAYA (Studi Kasus: Kota Makassar)

Misuse of hazardous materials may risk human health and the environment. In order to protect consumer's rights from the illegal behavior of producers, importers, distributors, and other stakeholders along the distribution of goods and services, The Government has issued Trade Minister Regulation Number 44/M-DAG/PER/9/2009 regarding Procurement, Distribution, and Surveilance of Hazardous Materials. This study is conducted in Makassar City, and the objectives of this paper are to identify and to evaluate the implementation of the Trade Minister Regulation. By using Regulatory Impact Assesment, the study reveals that Trade Minister Regulation Number 44/M-DAG/PER/9/2009 regarding Procurement, Distribution, and Surveilance of Hazardous Materials needs to be revised and consummated in order to provide effectiveness and prevention of misuse of hazardous materials, especially in foodstuffs. Penyalahgunaan bahan berbahaya dapat menyebabkan resiko bagi kesehatan manusia dan juga lingkungan hidup. Dalam rangka melindungi hak-hak konsumen dari penyalahgunaan yang dilakukan produsen, importir, distributor dan setiap pihak yang berada dalam jalur perdagangan barang atau jasa, pemerintah menetapkan Peraturan Menteri Perdagangan Nomor: 44/M- DAG/PER/9/2009 tentang Pengadaan, Distribusi dan Pengawasan Bahan Berbahaya. Penelitian ini dilakukan di Makassar untuk mengetahui gambaran pelaksanaan sekaligus mengevaluasi Permendag. Dengan menggunakan metode Regulatory Impact Assesment (RIA), hasil penelitian menunjukkan bahwa Permendag tersebut perlu direvisi dan disempurnakan sehingga pelaksanaannya bisa lebih efektif dan tidak terjadi penyalahgunaan B2, khususnya yang terkait dengan bahan pangan.
